Portugal Land Classification

Public-utility easement or restriction (servidão ou restrição de utilidade pública): can you build on it in Portugal?

Independent site: we are not a public authority, and this is not legal or tax advice.

It depends on the restriction: an easement or restriction of public utility (servidão ou restrição de utilidade pública, SRUP) can limit or block building, and the PDM's constraints map must show those in force.

Answer
Check the constraints map before assuming you can build.
Where to look
The PDM's constraints map (planta de condicionantes); the DGT lists SRUP by municipality.
Who decides
The municipality decides the permit, after the opinions each restriction requires.
Council rules
The municipal plan (PDM) sets the detail for your plot; ask the council for a planning certificate (certidão) and the plan maps.
Legal basis
RJIGT (Decreto-Lei 80/2015), contents of the municipal plan
