Special Protection Area for birds (ZPE): can you build on it in Portugal?
It depends on the plan: a special protection area (zona de protecção especial, ZPE) is part of Natura 2000, and licensing of listed acts needs the nature authority's favourable opinion where plans do not secure the conservation aims.
- Answer
- Possible only under the area's conservation rules.
- Definition
- An area classified to protect wild birds, forming part of Rede Natura 2000.
- System
- Part of the national system of classified areas (SNAC).
- Who decides
- The municipality decides the permit; the nature authority (ICNF) gives the binding opinion.
- Council rules
- The municipal plan (PDM) sets the detail for your plot; ask the council for a planning certificate (certidão) and the plan maps.
- Legal basis
- Decreto-Lei 140/99 as republished in Decreto-Lei 49/2005; Decreto-Lei 142/2008, article 9
